DHS Secretary Markwayne Mullin stated in the August 20, 2026 press release: 'If it weren't for Biden's reckless America Last policies, this woman would still be alive and her killer wouldn't be here.' That makes the claim assessable rather than merely rhetorical.
A counterfactual about one individual cannot be directly tested. But it rests on premises that can be, and they do not hold up.
The mechanism is probably misidentified. As established in claim 1, combining Fairfax County police (age 19 at his August 2026 arrest) with DHS (April 2024 crossing) puts him at 16 or 17 at entry. For an unaccompanied minor from El Salvador — a non-contiguous country — the Trafficking Victims Protection Reauthorization Act of 2008 requires DHS to transfer the child to HHS custody within 72 hours, after which the Office of Refugee Resettlement places them with a sponsor pending removal proceedings. That is statute, not administrative discretion; changing it requires Congress. If he entered with family, the Flores settlement independently limits detention of minors to roughly 20 days. So 'a different border-parole policy' would most likely not have produced a different outcome, because parole policy was probably not the operative legal channel. Neither DHS nor any outlet has addressed his age at entry, so this is a well-grounded inference rather than a settled fact.
The generalizable premise is contradicted by the best available research. Light, He, and Robey (PNAS, 2020), using Texas Department of Public Safety data for 2012–2018, found undocumented immigrants roughly half as likely as native-born citizens to be arrested for homicide, felony assault, and sexual assault. Cato's analysis of Texas conviction data for 2013–2022 found an illegal-immigrant homicide conviction rate of 2.2 per 100,000 versus 3.0 per 100,000 for native-born Americans — about 26 percent lower. Abramitzky et al. (NBER Working Paper 31440, forthcoming in American Economic Review: Insights) found immigrants have not had higher incarceration rates than the US-born at any point in 150 years, and are roughly 60 percent less likely to be incarcerated today. Cato's 2010–2024 incarceration analysis reports illegal immigrants about half as likely to be incarcerated as native-born Americans.
This research is contested and I note the dissent for completeness. The Center for Immigration Studies (Camarota, Richwine) argues Texas DPS data understates illegal-immigrant criminality because offenders migrate out of an 'other/unknown' status category over time and are misclassified as native-born in the interim; Cato responds that CIS's approach also shrinks the denominator, mechanically inflating the rate, in tension with CIS's own population estimates elsewhere. Even accepting the CIS critique in full, however, an aggregate rate dispute establishes nothing about individual-case causation.
The crime type cuts against the framing specifically. Fairfax County Police Chief Kevin Davis said the suspect and victim were restaurant coworkers in an intimate relationship. This was an intimate partner homicide. Established IPH risk factors are relational — coercive control, jealousy and possessiveness, prior abuse, forced sex, strangulation, threats to kill — not immigration status. Where researchers observe elevated foreign-born IPH rates, they generally attribute them to help-seeking barriers, including fear that contacting police will jeopardize immigration status, rather than to status as a causal factor. That mechanism arguably runs opposite to the post's implied remedy: the victim herself appears to have been a Latina immigrant, and aggressive enforcement is associated with reduced domestic violence reporting among immigrant communities.
What survives is a narrow tautology: had he never entered the United States, he could not have committed this specific homicide in Virginia. That is true of any offender and any border, and it is not what the claim asserts. The claim asserts that a specific policy lever — border parole — was the but-for cause, and the evidence indicates the lever was probably a different one that no administration controls, while the general prevention logic the claim depends on is contradicted by the aggregate literature. Note also that DHS itself has previously acknowledged the limits of this inference pattern, telling reporters that immigrant criminal-conviction data 'includes individuals who entered the country over the past 40 years or more, the vast majority of whose custody determination was made long before this Administration.' |
