I'm sitting here shocked because, you know, I spent over three decades with others. And it's just incredible, these numbers. That's what you get when you end catch and release. You know, President Trump ended catch and release. These people shouldn't be walking around the streets. However, they restart catch and release. And while they're releasing these people, understand this, there are thousands of empty ice beds. Ice beds already paid for by ice, already paid for sitting empty while these people are around the streets. And here's the scary part, as Bill said, not only we got 2.2 million known data ways, right? And we don't know who these people are, but we know they didn't get fingerprinted, didn't get vetted at all. But even with these numbers, people need to understand the vetting process on the Southwest border. Many people do get vetted on the Southwest border. We don't have access to criminal data, like from El Salvador or Guatemala or Venezuela or China. So a lot of these countries, they can be criminals too, but we'll never know it because we don't have access to that data. So these numbers are obviously much higher than that. But it's, and look, and I agree with Bill on this, sanctuary cities are sanctuaries for criminals. President Trump sued sanctuary cities. We're in a middle lawsuit at the end of his presidency. When the first thing Joe Biden did, he got in the office and told DOJ to drop the lawsuit. So it's like the perfect storm for American public safety. It's just incredible. - So Tom, how does this happen? We're told by the Biden administration that, oh, these people are coming across the border illegally, but we're vetting them. We're putting them through a process. And then if eligible, they're allowed to remain in the United States. How did they miss the part about convicted murderers? How did they miss the part about convicted of rape or sexual assault? - 'Cause of vetting, the vetting is terrible. Like I said, Bill, when you vet somebody, you only vet them against NCI databases. And some countries share criminal data, but most don't. And look, the example of that was three weeks ago where they arrested a person in Venezuela that was here in the United States that was wanted for over 20 murders in his home country. But we didn't have that data during the vetting process. So that's the problem. And that's why you don't end, that's why you don't end detention. You don't do catch release like President Trump. They keep these people in custody till we have time to drill down in their histories and make sure we know who these people are. And even the APD alternatives to detention, these people are released on some sort of boarding procedures. And here's another thing. ICE has decreased significantly how many of those people are no longer on GPS. They used to be on an echo monitor, a phone that tracked my GPS. GPS has been cut tremendously because they don't want these people tracked. Look, this is a scary part. This administration is lying to American people and people are not showing up in court. And here's the thing. If you look at the Homeland Security Life Suck Report, for those 90% of asylum seekers who are gonna get order removal in the future if they simply don't fall for asylum, if you look at the Homeland Security Life Suck Report, like when it comes to family, only 6% of that 90% actually leave the country because we can't find them. Again, a massive failure by this administration to come out of here. - Yeah, Tom, I've heard a lot of warnings from you before, but perhaps none like you just said after learning of this news. You called it the perfect storm for American public safety. What is it that you're suggesting? I mean, based on these numbers, 13,000 convicted illegal alien murderers roaming the country, 15,000 convicted rapists are here, over 400,000 convicted criminals are now roaming the country. What are you suggesting this could look like when you call it the perfect storm? - Well, people are saying, we talked about crime up to this country. And of course, in the left pushback, there's no such thing as a migrant crime search. Yes, there is, and this is more evidence of it. And look, Tamala Harris is not gonna fix the border. Matter of fact, she should be ashamed of even going to the border because she broke it. We handed this administration the most secure border of my lifetime, and they unsecured it on purpose. She compared the ICE to the KKK. She attacked the men of the Border Patrol, Horse Patrol Condom Races. They have opened the flood gate. And remember this, Secretary of State of New York just has told ICE, you can't even look for somebody who's in the country illegally. That's a convicted of mysterious crime. And so, you know, most illegal hands are running around free knowing that no one's looking for them because of the policy of this administration. Look, I'll say it again. This is why we need President Trump back in office, who will, number one, secure the border and catch release and hold sanctuary cities accountable. Sanctuary cities, even some sheriffs will say, well, we're a sanctuary because we want victims and witness of alien crime to feel welcome to come and report that crime without fear of what's working with ICE. That is a stone cold lie because victims and witnesses of a crime don't want the bad guy released back in their community to take revenge. And so I said, sanctuary cities are sanctuary criminals. And Bill mentioned it. When you release a bad guy from the county jail, ICE is gonna do the job and go look for that person. And that's gonna put the officer at great risk 'cause he's trying to access, we don't know what weapons when he was in a safety and security of the jail. It puts the immigrant community at greater risk of crime 'cause a bad guy's gonna go back in that community to re-offend. It puts the immigrant community at greater risk of vice arrest 'cause we go find that bad guy. He's probably gonna be with others that weren't even on the radar. And I would tell any politician to believe in sanctuary cities, go to the immigrant community and ask them one simple question. Would you rather have ICE in the jail or in the community than most say the jail? 'Cause immigrant communities, even though many across this country are legally invited to law here illegally, most of God, fear, and family, people that wanna protect their families too. So they don't want predators in their neighborhoods either. So this is another barrier of the Harris Administration that can only be fixed by putting Donald Trump back in office and doing what we did best, making the border the most secure border we've ever had. And that was proven by data. That's not, that's just a stone cold fact. And taking the handcuffs off ICE so ICE can go look for these people who are here illegally and convicted of the most heinous crimes, let ICE do their job, they're good at it, but you gotta let 'em do it.

Is Homeland Security enforcing the DNA collection law? Not fully. As a result, are Americans less safe? Yes. No question in your mind. It already is. Our team sat down with three government whistleblowers with seven decades of law enforcement experience. They work at Customs and Border Protection, or CBP, a division of Homeland Security. This internal government memo confirms that you were retaliated against because you spoke out against officials at Homeland Security who you believed were violating the law. Yes, 100 percent. The agency's intentional decade-long failure to implement a law designed to protect public safety. That's its conclusion. Customs and Border Protection is in violation of the federal law and it's done knowingly. Yes. This internal Homeland Security directive marked law enforcement sensitive lays out the law. The border agency is required to collect DNA samples from non-United States persons in detention for immigration violations. Known as the DNA Fingerprint Act, it passed in 2005 with bipartisan support. So there's no ambiguity. The language is clear. It lays it out as a road map. Have you ever seen a directive like this be ignored? Never, no. Okay, a lot of people are going to be confused. Homeland Security's job is to uphold the law and to keep Americans safe. But what you're alleging is that Homeland Security is not complying with the law. That's correct. Since 2021, under the Biden-Harris administration, Homeland Security's own data reports more than 10 million border encounters. The internal mood is it's a dumpster fire. It is a questioning of our mission versus what is actually being executed in the field. Jones showed us what's supposed to happen in the field when DNA is collected from individuals detained and processed on immigration violations. So, Katherine, this is the kit that's provided by the FBI to the Customs and Border Protection officers and agents. Place it inside your cheek. Okay. Rub inside your cheek three times. Three times, yeah. You're collecting saliva and skin cells or epithelial cells. Okay. I would then take it back from you, close it, place it inside the white envelope, which then gets sent to the FBI laboratory for processing. So, 30 seconds to collect, about $4 a pack. Correct. How long to process by the FBI? Approximately 72 hours. So, it helps you identify suspects. Absolutely. It gives an investigative lead to a law enforcement agency. Has the system solved cold cases? Yes. It's presumptively solved over 1,000 cases just from DNA collection. Not only does it cut down on crime, it also cuts down on the time that it takes law enforcement to find this individual. You've had Republican administrations. You've had Democratic administrations. Have either of them implemented the law? No. The willful noncompliance, I believe, is inexplicable. For many years, the Department of Homeland Security and Customs and Border Protection have failed to follow the law. Recent data released by Republican Senator Chuck Grassley suggests nearly 70% of border encounters did not include DNA collection as required by law, and as many as 950,000 violent criminals were unidentified. 950,000 violent criminals went unidentified. That's nearly a million people. That estimate was from 2010 through 2019. That was five million illegal entries at the time. What you're saying to me is that 950,000 violent criminals is an old number. It's on the low end. Yes, ma'am. The continued prolonged willful failure to comply with the DNA fingerprint act has resulted in the harm that Americans are dead and these deaths were preventable. That's a very significant statement. I believe that to be statistically verifiable. The August 2023 sexual assault and murder of a 37-year-old mother of five in Bel Air, Maryland haunts the whistleblowers. Are you alleging that Homeland Security's failure to comply with the DNA collection law may have been a contributing factor in Rachel Morin's death? It may have been a contributing factor, yes. No question in your mind? None. That's a very serious charge to make. It is. Now charged with Rachel Morin's murder is 23-year-old Victor Antonio Martinez-Hernandez from El Salvador. An alleged gang member, authorities claim he murdered another woman before fleeing to the U.S. in February 2023. Based on our reporting, the suspect didn't just have one encounter with border agents. He had multiple encounters. So there were multiple opportunities to take his DNA. We understand we had three bites at the apple with this subject and never took it. It's going to be hard for the family to hear that there was an opportunity to identify the suspect and stop him if federal law had been followed. Absolutely. Had the subject had DNA taken the first time they were encountered, there would have been an instant possibility that any future criminal activity would have been stopped immediately and there was definite potential for the individual to be apprehended. Six months before Rachel Morin's murder, the suspect was linked to a brutal home invasion in Los Angeles. I think if due diligence was exercised and we comply with the law, DNA was collected. We would have known who we were looking for on behalf of the little girl and the young lady out in Los Angeles and hopefully been addicted along before he got to Maryland. Did Homeland Security fail Rachel Morin? In the context of not collecting the DNA that is mandated by law, they did not do it and there's no other answer. Even independent government investigators admitted in this May 2023 letter that border agencies do not systematically record data on the reasons for the non-collections. What's the consequence for the American public? We know for a fact that not every individual who crosses the border illegally into the United States goes on to commit violent acts, but given the number, even a very small percentage results in a definite increase in crime within the United States. Does Homeland Security owe the victims an apology? Does Customs and Border Protection owe the victims an apology? At a minimum, many people in this country are owed an explanation. Ultimately, the Secretary of Department of Homeland Security is responsible. We know that he's been notified of the non-compliance. They've done so with impunity. Has anyone at Homeland Security been disciplined? Not that we're aware of. No. Demoted? No. No, and to the contrary promoted? Promoted. Anyone fired for failing to comply with the DNA law? No. No. The only ones disciplined are sitting right here. This exclusive internal memo concluded the border agency retaliated against them, including denial of promotion, hostile work environment, reputational harm, among other issues. How hard did you have to work within the government bureaucracy to get this memo? The Office of Special Counsel refused to give it to us. We received it through discovery with our legal counsel. So you had to spend your own money to get confirmation that you were being punished by the government. That's correct. For me personally, it's a mystery as to why the Office of Special Counsel did not see fit to share that document with us. I've had my law enforcement credentials, firearms taken away from me. I've had my law enforcement retirement taken away from me. And we will tell you this in a law enforcement environment, publicly removing someone's firearm is the ultimate insult and degradation. I was basically iced, left to sit at my desk every day, do nothing but the most menial tasks. My future career options, because I was working in such a limited sphere, all that future potential vanished in a day. I was demoted three levels. Like Mr. Taylor, my firearm was taken, my credentials were taken, and it was the final blow to a professional career. And what we did was we came forward. Not in 75 years or so of combined service, have one of us even had a written or verbal disciplinary action. One of the supervisors said, very matter of fact, the agency's goal is to bankrupt you, make you quit, die, kill yourselves, or basically preferably all of the above. What you describe sounds like a criminal conspiracy. We think a lot of this is criminal, not so much even when it comes to us, but the absolute intentional dereliction of implementing the DNA law. We don't need to bring in more crime. We have enough of our own. The tool we have, the DNA Fingerprint Act, we are willfully not complying. And we ask ourselves, how is this happening?
