Time Magazine wrote a relatively good story about me, but the picture may be the Worst of All Time. They "disappeared" my hair, and then had something floating on top of my head that looked like a floating crown, but an extremely small one. Really weird! legal analyst, Greg Jarrett, former Harvard law professor, Alan Dershowitz. Let's go to the Trump issue first. Professor, we know the Supreme Court has ruled on the issue of presidential immunity. We know in this case that evidence was presented to that jury, Hope Hicks, for example, testimony given in that case directly tying Donald Trump to the time he was in the office. That case on every measure should be thrown out, a novel legal case, statute of limitations long gone for a legal NDA that was labeled an NDA and put together by a lawyer for the president. Well, this is a slam dunk for appeal, which is exactly why Greg doesn't want it to go to appeal. He wants to campaign for office next year with the scalp of Donald Trump saying, "I have him. I have him convicted by a jury. He wants to make sure when he serves as president, he's always referred to by CNN as a president who was convicted by a jury." This is an attempt to circumvent the appellate process. It's illegal. It's unethical. It's unconstitutional. It's immoral. And my advice to the Trump lawyers is if Marshawn says he's going to put this sentencing off for four years, immediately file a writ of mandamus to the appellate courts. It's a very, very appropriate writ because the writ of mandamus is designed to get review when you can't get an appeal. And here, by denying him the right to be sentenced right now, they're denying him the right to appeal because under New York law, you can't appeal until you have a final judgment. And a final judgment means a sentence. So this is an attempt to circumvent the law. It's an attempt to put Greg above the law. And I think the courts will hold him responsible and will do the right thing and reverse this conviction on appeal. Do you agree with that, Greg Jarrett? Or maybe just let the judge sentence Donald Trump, then go through the appeals process while he is president. Sure. Well, we just don't know what he's going to do. But I do agree that delaying the Trump case for four years is ludicrous. It's an insult to justice and it violates state law, by the way, that requires sentencing within 12 months from conviction. The dilemma for Trump's lawyers is that they cannot appeal all of Mershawn's chronic reversible errors at trial until there is, as the professor points out, an adjudication. Well, that happens at sentencing. They can, however, immediately appeal if Mershawn denies the motion to dismiss on the immunity claim. If the judge refuses to rule, and that's what he's doing right now, they should seek a writ of mandamus from a higher court, force him to do his job, for goodness sakes. But also the defense still has pending a petition to remove the case to federal court where it belongs, because this was always an incoherent prosecution. It should never have been brought. Bragg manipulated the law, transforming misdemeanors into phantom felonies. He claimed it influenced the election. Well, guess what? The transactions happened after the election. And it's not a crime to conceal a perfectly legal non-disclosure agreement. People do it every day. So in the end, the conviction will never stand up. Mershawn and Bragg know it. That's why they want to delay the inevitable. All right, I'll stay with you.

But before we get to them, I've been doing a lot of thinking, as most of you have, about what took place in that courtroom last week and its implications beyond getting into the weeds of grand juries and jury instructions and collateral evidence and so forth and so on. Because it's so much bigger, so much bigger than the rules of evidence and so forth. What am I talking about? The Democrat Party, the Democrat Party is cheering what took place. Their surrogates are cheering what took place. Joe Biden went to a microphone and lied about what took place and then sneered after it. This is part and parcel of their war on the Constitution almost from day one, almost from day one. This is the party that supported nullification and slavery. This is the party that supported separate but equal, that is segregation. This is the party that supported Jim Crow. This is the party that supports and embraces American Marxism, which rejects the Constitution and the founders and the framers. They use the 14th Amendment in order to try and prevent Donald Trump from running for president, and this is what they do. And that's what happened in New York. Let me put it to you bluntly. South Carolina. Was the point. In which the Constitution came under attack, came to a head. It resulted in the Civil War. New York is the new South Carolina. That is the Confederacy. What do I mean by that? I'm not arguing here that there will be a violent civil war. I don't know what comes. Nobody does. What I'm arguing here is the Civil War was about slavery and about the attack on the Constitution and the attack on the Union, the nation. What took place in that courtroom? The jury should never have been impaneled. A Soros prosecutor and a Biden judge, in effect, decided that they were going to launch a war against our constitutional construct. How so? By nullifying the Due Process Clause of the Constitution in the Fifth Amendment, by nullifying the Due Process Clause that applies to the states through one of the post Civil War amendments, the 14th Amendment. And if this stands, the consequences will be very dire for the future of this country and the Constitution. Let me put it to you this way. New process goes back to the Magna Carta of 1215. But the phrase itself appears in a statute that was passed in Britain to incorporate the Magna Carta in 1354. And that was during the reign of King Edward the Third. And so we have this process where we have the Fifth Amendment and the 14th Amendment. And what do they say with respect to due process and equal protection? They say exactly the same thing. In essence, no one shall be deprived of life, liberty or property without due process of law. The 14th Amendment was adopted by Congress in 1866 before it was an amendment. They proposed it to the states, which then ratified it in 1868. The Fifth Amendment was added to the Constitution as part of the Bill of Rights in 1791. So this is ingrained now in our country, ingrained in our country. And what took place in the Magna Carta was the first massive assault. Massive assault on the Union. A due process on equal protection since the Civil War. There have been individual cases, but the impact of this, the presidential candidate, your former president, the purpose of which is to influence a national election, we've never seen anything like this, anything like this. And it has now been resuscitated after we thought the Civil War put the whole idea of nullification to bed. Now, let me go further on this. Our friends at the National Constitution Center, nullification is the constitutional theory that individual states can invalidate federal laws or judicial decisions. They deem unconstitutional. And it has been controversial since its assumption in American history because the Constitution doesn't provide for nullification per se. Now, that said, this is even worse than nullification than we've seen in the past, nullifying federal laws. This is a nullification of two amendments to the federal Constitution. A nullification of amendments to the federal Constitution that basically enshrine the entire belief system in the Declaration of Independence. Your right to life, liberty and the pursuit of happiness. James Madison is considered Mr. Constitution. This issue of nullification was raised with him by a former Senator, Edward Everett, and James Madison wrote a very long letter back to him on August 28th, 1830. And he said this in part, being thus derived from the same source as the constitutions of the states, it has within each state this idea of nullification, the same authority as the Constitution of the state, and is as much a Constitution in the strict sense of the term within the prescribed sphere as the constitutions of the states are within their respective spheres, but with the obvious and essential difference that being a compact among the states, that is, the Constitution in their highest sovereign capacity. The states adopted the amendments, excuse me, the Constitution. And constituting the people thereof, one people for certain purposes, that is, you're a citizen of a state, but you're also a citizen of the United States or the federal Constitution, it cannot be altered or annulled at the will of the states individually as the Constitution of a state may be at its individual well. In other words, a state constitution or state legislature cannot nullify the nature of national citizenship that was adopted by states, by states. These amendments later we'll get into. It's worse in this case in Manhattan because the state as an entity is enacting. It's a piece of the state, a small piece of the state, one judge and one prosecutor. So it's worse. He says between these different constitutional governments, the one operating in all the states, the others operating separately in each with the aggregate powers of government divided between them, it could not escape attention. The controversies would arise concerning the boundaries of the jurisdictions and that some provision ought to be made for such occurrences. A political system that does not provide for a peaceful and authoritative termination of current controversies would not be more than the shadow of a government, the object and end of a real government being the substitution of law and order for uncertainty and confusion and violence, which, of course, is exactly what Bragg and Mershawn have done, have done in their courtroom, not the state legislature, not the governor. Two people, two people. He goes on, quote, that the Constitution and the laws made in pursuance thereof and all treaties made under the authority of the United States shall be the supreme law of the land, too, that the judges of every state shall be found thereby by anything in the Constitution and laws of any state to the contrary notwithstanding, three, that the judicial power of the United States shall extend to all cases of law and equity arising under the Constitution, the laws of the United States and treaties made under the authority thereof. Well, the issues that took place in that courtroom arrives under the federal Constitution, which is why Joe Biden, an old confeder who supported racism and segregation, opposed Brown versus Board of Education by opposing the integration of our public school systems. That's why he got up and said this is a state court issue. No, it happened in a state court. That doesn't make it a state court issue. Madison goes on, he says, with respect to the judicial power of the United States and the authority of the Supreme Court in relation to the boundary of jurisdiction, between the federal and state governments, I may be permitted to refer to the 39th number of the federalists for the light in which the subject were discarded by its writer, meaning him, he wrote it, at the period when the Constitution was depending, and it is believed that the same was the prevailing view then taken of it, that the same view has continued to prevail and that it does so at this time, notwithstanding the imminent exceptions to it. He said, there is no nullification right under the Constitution. Period. And what I'm saying is what took place in that Manhattan courtroom was the nullification of a part of the Bill of Rights and the 14th Amendment, one of the Civil War amendments. Finally, he says, in part, what the fate of the Constitution of the United States would be if a small proportion of the states could expunge parts of it, particularly valued by a large majority and have but one answer. And he meant by that a civil war. That's 1830. He could see it coming. In 1834, he wrote a long treatise on this December about nullification, and I'm not going to read it to you in full, but I'll read one section. It follows from no view of the subject that a nullification of a law the US can, as is now, contended, belong rightfully to a single state, is one of the parties to the Constitution. The state not ceasing to avow its adherence to the Constitution, a plainer contradiction in terms or a more fatal inlet of anarchy cannot be imagined. He said that New York's part of the United States of America. It signed on to the Constitution. I can't now say, OK, but as far as the due process rights go in modern time, we're going to allow Mr. Bragg and Mr. Mashan to have their way. To basically eviscerate it to nullify its application. In that courtroom. To a presidential candidate and a former president. Well, who wrote this 14th Amendment? Section one, which is what we're focused on at the 14th Amendment, the main author was a congressman from Ohio, a Republican by the name of John Bingham. And he went to the floor of the House when he was arguing for his amendment. And he said, among other things, this is 1866. The amendment was ratified or adopted in 1868. I think, sir, that the honorable gentleman from Vermont has uttered words that ought to be considered and accepted by the gentleman of the House when he says that the action of this Congress in its effect upon the future prosperity of the country will be felt by generations of men after we shall all have paid the debt of nature, I believe, Mr. Speaker, as I've had occasion to say more than once, that the people of the United States have entrusted to the present Congress in some sense the care of the Republic, not only for the present, but for all hereafter. Your committee, sir, would not have sent to this House for its consideration, this proposition, this proposed amendment, the 14th. But for the conviction that its adoption by Congress and its ratification by the people of the United States is essential to the safety of all the people of every state. I repel the suggestion made here in the heated debate that the Joint Committee on Reconstruction or any of its members who favor this proposition, seek in any form to mar the Constitution of the country or take away from any state any right that belongs to it or from any citizen of every state of any state, any right that belongs to him under the Constitution. The proposition pending before the House is simply a proposition to arm the Congress of the United States by the consent of the people of the United States through the ratification process with the power to enforce the Bill of Rights as it stands in the Constitution today. It has that extent and no more, he points out. He says, gentlemen, admit the force of the provisions of the Bill of Rights that the citizens of the United States shall be entitled to all privileges, immunities of citizens in the United States and the several states and that no person, none, shall be deprived of life, liberty or property without due presence, the law. But they say we were opposed to its enforcement by act of Congress under an amended Constitution as proposed. That's the sum and substance of all the argument we have heard on this subject. Why are the gentlemen opposed to the enforcement of the Bill of Rights as proposed because they are very it would interfere with the reserve rights of the states, whoever before heard that any state had reserved to itself the right under the Constitution of the United States to withhold from any citizen of the United States within its limits, under any pretext, whatever any of the privileges of a citizen of the United States to oppose upon him, no matter from what state he may have come, any burden contrary to that provision of the Constitution, which declares that the citizens shall be entitled in the several states to all the immunities of a citizen of the United States. He ends the question is simply whether you will give by this amendment to the people of the United States, the power by legislative enactment to punish officials of states for violation of the oaths enjoined upon them by their Constitution. That is the question and the whole question. The adoption of the proposed amendment will take from the states no rights that belong to the states. They elect their legislature. They enact their laws for the punishment of crimes against life, liberty or property. But in the event of the adoption of this amendment, if they conspired together to enact laws refusing equal protection to life, liberty or property, that Congress is thereby vested with the power to hold them to answer before the bar of the national courts for the violation of their oaths and the rights of their fellow man. Why should it not be so? Is the Bill of Rights to stand in our Constitution hereafter as in the past five years with 11 states, a mere dead letter? Thank you very much. Here we go again. Five weeks. I've been here. I'm gagged. I'd like to answer all of your questions. They're very easy questions to answer, but I'm gagged, so I can't talk as much as I would like to about this ridiculous case that's hurting our country so badly. Some of the reviews from yesterday are the -- and by the way, everyone's against this case, too. I haven't seen one legal scholar or expert in the law say that this case should have been filed. It should not have been filed, or at a minimum it should have been filed seven years ago. Seven years old. Everybody turned it down, including federal elections turned it down. Southern District turned it down. Bragg turned it down. Then he rejuvenated it when I was running for office. It's a terrible thing. At the request of Biden, the editors of the National Review say, "Quit Trump." Bragg has failed to prove his charges. Totally failed. Greg Jarrett. Because all of the stuff came in after the elections. How were they defrauded? And then you say, "What about Hillary with the dossier? What about all of the other things that go?" And this is nothing. This is nothing. But what about all of the corruption, the voter fraud, that you've seen over the last year on behalf of the Democrats, and nobody talks about it? This is ridiculous what they're talking about. This is called running for office. Greg Jarrett. The government, which received full payment on all taxable income. The government, by the way, received full payment. The taxes were paid in full. In fact, they made comment on that. Even if the taxes were paid in full, the federal elections commission that concluded the money paid did not constitute a campaign contribution under the law. And remember, this judge wouldn't allow us. He's a very conflicted judge. Everybody knows that. You don't want to talk about what the conflict was. I'm not allowed to talk about it because of a gag order that he put on me. It's the one subject he really doesn't want to talk about. There was no fraud. There was no conspiracy. It's that simple. Moreover, without a primary crime, there can be no secondary crime. It's a classic lawfare, weaponizing statutes. Because the law has been -- okay, because no law has been broken. There's a jury chair. Elihonic legal analyst for CNN. The crime here is not easy to explain or to understand. It's just not understandable. In other words, there is no crime. This is CNN. Catherine Christian from MSNBC -- I call it MSDNC -- legal analyst. It's difficult because it's a very nuanced argument. It's never been prosecuted before. This is an argument that has never been prosecuted before. And hopefully, it'll never be prosecuted again. Andy McCarthy -- this is anything but standard. It's the antithesis of standard, actually. The idea that they do not have to agree on what the other crime is. We spent six weeks wondering, "What is the other crime? What is the other crime?" And at the end, the thud we all get is this. There's three or four of them, and you could pick one from the other, and they don't have to agree on anything. And what he's saying is it's so -- it's so corrupt. Nobody has ever heard of anything like this. It's called "pick 'em." It's like the latter. You pick 'em. You pick 'em. And you don't have to be -- even though in a criminal case, you have to be unanimous, you don't have to be -- just give a couple of votes, because the judge, unfortunately, is corrupt. Judge Jeanine Pirro, no one has heard of this. It's like it's a menu column A, B, or C. You don't have to agree on it. This is a kangaroo court. This is unheard of. I've never seen anything like it. I've done this for 32 years. I'm not a federal prosecutor or a state prosecutor, so I know what I'm talking about. I'm not a federal judge. I'm a county judge, just like Russia. This is New York law. That's the best we've ever had. They said this is the single-best ball that Trump has ever had with independents. Trump's largest lead among independent voters -- NPR, Marist College -- 44-28. And Junior is way down -- way, way down. But it's -- it's -- 44. Junior is extremely liberal. By the way, he's extremely radical left. I think you know that. But he seems to be hurting Biden probably a little bit. So that's it -- it's a disgrace. The millions and millions of dollars that have spent daily on this case -- outside, it looks like it's Fort Knox, like the Guardian -- I've never seen so many police them. that the doj law that they're now relying on because new york state statutes don't cover this it's only a misdemeanor uh even in that case biden's doj passed on charging donald trump because they didn't think it was applicable you know how are we here and it's an it's a venue that is not friendly to donald trump you could still get a guilty verdict out of this jury that's scary to me it is scary and it is very much in the play here that i think that bragg is hoping the jury will not look beyond the identity of the defendant because you know the fact is they're saying well you shouldn't have listed this as a legal expense all right what is he supposed to list it as what if he put down nuisance payment what if he put down settlement of personal embarrassment would that really convert this to a non-crime there wasn't a crime here because this wasn't a federal campaign contribution the department of justice as you noted did not see that as a criminal act they did not charge that and so once again you get back to the role of the judge here that we're going through a trial that seems desperate to find a crime but you can't even get that from the indictment or the opening statements the fact that we had to wait for the opening statements for bragg to even fully articulate what his theory was shows how weak this case really is and it's only that weakness is only becoming more and more evident every day but okay but but what what i see them trying to do and correct me if you think i'm wrong i see that they're trying to muddy the waters they're using a lot of loaded terms about donald trump uh they sound like they're trying to make this into the crime of the century there's no applicable law and now you've now the defense has to explain all of that to mostly non-lawyers that are on a jury there are two lawyers apparently on the jury so my question is well what would you say to donald trump's attorneys how would you argue the smoke and mirrors that they keep throwing up and where are the objections i'd like to see more objections well they're going to have to keep on hammering away to this jury that it's not a question of proving facts that are lawful it's like saying we're going to approve we're going to show you he drove 55 miles an hour down the highway well you're allowed to do that right so they're setting up all of these factual claims that can be proven because they're largely not denied this the really reversible error in this case may come down to the instructions and how the judge tries to put this together for the jury because at some point he's got to inform the jury that there's nothing unlawful about an nda there's nothing this is not a federal campaign contribution in the view of the federal government but to make those legal issues clear is to disassemble this case so we a lot is going to be sort of unfolding here but i think the trump team has done a very good job so far in bringing that out and we're going to be looking at some major fireworks in the next few days you know when when you put cohen on the stand you're going to have a truly circus-like environment i mean you've got someone who a judge just recently denounced as a serial perjurer and he's going to get on the stand and he's going to be the star witness yeah and and you have a biden donating uh perhaps conflicted judge that should have been recused or should have recused himself uh which obviously would be an issue upon appeal but any appeal may happen after the election that that doesn't help. But with Donald Trump, well Bragg who reduced 60% of all felonies to misdemeanors, well he twisted the law into a pretzel, bending over backwards, spending millions of your dollars to bring a case that frankly never should have been brought. For Democrats, the mob and the media, it is worth every penny, even sacrificing the rule of law and our great constitutional republic. Now according to echelon insights on behalf of the heritage foundation, he's up 10 in Georgia, seven in Nevada, six in Michigan and in Arizona, and he leads Biden by four in Pennsylvania. Biden nips Trump by one point in Wisconsin. And it must have killed Axios to report on a New York Times/Ciena college poll that was just out. The poll found a big increase, nine points, in registered voters who believe that Trump left the country better off.

- All right, let's bring in Fox News legal analyst, Greg Jarrett. So Greg, it's finally gonna happen. How many days do you think this will take to get 12 jurors and six alternates? - Could take as long as 10 days, maybe two weeks, but it's really up to the judge to limit the amount of wadir, the questioning of the jurors and move forward. But I must tell you, I've never seen such a tangled, torturous prosecution that would be brought against no other person except Trump. It's punitive, it's politically driven, brag, contorting the law, taking a business record, misdemeanor, barred by the statute of limitations, and magically inflating it into 34 felonies, as Eric Sean pointed out. To do that, he had to attach it to a supposed election law violation. Well, it's not. Federal Election Commission investigated, and they said this is perfectly legal. It is not a campaign donation. The DOJ concluded there's no crime here, but enter Alvin Bragg, who's charging under federal law, even though he's a local prosecutor and has no jurisdiction and authority to do that, but the judge is letting him get away with it. - So I just gotta stay on that point about the judge, because Michael Avenatti, who's no former, no fan of the former president, had this to say on Twitter. He talked about the DA encouraging Cohen and Daniels to go out there and do media interviews, and then he followed it up by this. He said to my friends on the left, who insist that they want to preserve democracy and justice, you should be equally outraged by this. Constitutional protections either exist for including the former president, or they don't exist at all. What is happening in this hush money case is a travesty. So if you got Michael Avenatti, who has spent his career, now he's on the other side of justice, trying to take down Donald Trump, saying that the judge is not being fair right here when it comes to a gag order. How can the former president expect a fair trial? - Well, a gag order is a clear violation of the First Amendment, but judges get away with it, because by the time it's challenged on appeal, the case is over. But this case is also something else, a classic example of unequal justice in selective prosecution. Hillary Clinton did pretty much the same thing. She too used a lawyer to secretly pay for the phony Steele dossier and booking it as legal expenses. She was fined by the FEC, but she wasn't prosecuted, and neither was Barack Obama, even though he was fined a whopping $375,000 for hiding donors and keeping illegal contributions. But if your last name is Trump, the standard of justice is completely different and turned on its head. - You're right, it's a double standard. Greg, let's talk about there, the prosecutor's star witness. It's Michael Cohen, he used to be Trump's lawyer exactly. We chuckle because he's flip-flopped so many times in the past, we don't know what to believe. He's been in prison for federal charges himself. So here is a reminder of what he has said, 'cause he told the grand jury a year ago, his goal was to tell the truth. But what is the truth? He flip-flops, listen. - I will be in DC and in New York, anywhere Mr. Trump deems necessary. I'll be there. I did not want to go to the White House. I was offered jobs. Not only is Donald Trump not a racist, he believes that all people are part of one race, the human race. I know what Mr. Trump is. He is a racist, he is a con man, and he is a cheat. The words the media should be using to describe Mr. Trump are generous, compassionate, principled, empathetic, kind, humble, honest, and genuine. He is capable of behaving kindly, but he is not kind. He is capable of committing acts of generosity, but he is not generous. He is capable of being loyal, but he is fundamentally disloyal. - Greg, how can this be the star witness? - You know Cohen, who is never much of a lawyer, is good, it seems, at only one thing, lying prodigiously. You know, Bragg's theory in this case is, well, Cohen pled guilty to campaign finance crimes, so Donald Trump must be guilty, too. Well, that's not the law. The plea of one person does not determine the guilt of another. It's not even admissible evidence at trial. And Cohen gratuitously pled guilty to a non-crime, just a curry favor with the feds in exchange for leniency for as many other crimes, including fraud. But get this, recently in court, he recanted what he stated in his sworn plea deal, which means he either again committed perjury in the plea itself, or perjury in his recent court testimony, and that prompted the judge to call Michael Cohen a serial perjurer. I can't imagine any objective juror believing anything he has to say. Any half-decent defense attorney will utterly destroy Cohen from cross-examination and expose his litany of lies. All right.
