Look, I think this issue of the big beautiful bill should be nonpartisan. I don't know how to tell what the hell is the matter with everybody up in Congress. People are dying every day. I use this wrestling three times many criminals that Biden administration did. We're taking public safety threats and national security threats off the street every single day, but we got over 600,000 illegal enemies of criminal histories walking the streets of this country. We got less than 5,000 deportation officers. This should be a no brainer. The more resources we get, we get this bill passed. We got more agents on, on, on the, on the road. We buy more beds. We get more transportation flights, more agents being more bad guys arrested, taking off the streets of this country every single day, every day. We rest a public safety threat or national security threat. This makes this country much safer. Who the hell would be against that? And I, and I get irritated. I get pissed off because I'm sick of meeting angel moms and dads. You want to talk about family separation. They bury their children. So this, I've done this since 1984. I've worked for six different presidents. No one has had the success of the Trump administration. We got the most secure border in the history of this nation today. But we, but we need more border wall border wall, save lives. Women and children can't get over that wall, which means they go to a place where there's not a wall and what's waiting on them, the men and women, the board of children who take care of this humanitarian needs and save their lives. We already got fentanyl seizures down half. Fentanyl seizures should be a hundred percent. We should have zero fentanyl come in this country. We need money to help secure that border at higher level. Stop the fentanyl from coming in. Stock the sec, stop the sex trafficking of women and children. Stop the known inspected terrorists coming across that border. Right now, I was looking at the stats today. I used to arrest in a record number of known suspected terrorists in this country, along with the FBI. With more money, we can arrest more of these people, make this country safer. This is a nonpartisan issue. Let's make this country safe again. So to the Democrats and the Republicans and the Independents, I don't care who you're from pass the bill. So we make this country safe so we can stop the violence against ICE officers. Let's make this country safe again. And without that bill, it's going to be a hard road. We got a lot of people to look for a lot of people to arrest. A lot of national security threats we know are in this country. We need to find them. We need more money to do that. We know we need more agents to do that. For God's sake, let's pass this bill and get this done.

Attorney David Schoen: “Trump’s Jan. 6 case is not like any other case!”

Welcome back, America. We're here with one of the great civil rights criminal defense lawyers of our time, David Shone. He also represented President Trump in one of the impeachment cases. You're familiar with him. David Shone, I want to talk about Judge Chunken for a moment. I've made the case that this setting the date on March 4th violates the Sixth Amendment, effective representation by counsel. There's 12.8 million pages of documents. You have five months to prepare. Even the feds couldn't say that they've ever had a case where five months was enough. And this is a very complex case. You have a lot of questions that are raised for the first time, complexity involving a former president, motions, filings. She also sets the date one day before Super Tuesday, the most important date in the election cycle in the Republican primary. She also jumps the line, jumps in front of the first case that's in Florida with Judge Cannon, who already set her trial date for May. And I'm sure that's created a lot of chaos down there on the other case. My argument, David Shone, is she's doing this. She wants a Democrat jury. She wants at least one conviction on one of the counts. So, Donald Trump is walking around with a scarlet letter. Convicted felons are the likes of Chris Christie and others, as well as Democrats can say, well, he's a convicted felon. What's your take on this? Well, I think we've seen just that sort of thing in some of her words. In other words, the lady doth protest too much, methinks. She has made clear that this is only, this is going to be treated like every other case for every other defendant and she won't cow-tow to election concerns and that sort of thing very defensively. Of course, it's not like any other case. There's a great public interest. The government spoke about a public interest in a speedy trial rather than the defendant's interest in a speedy trial. There's a greater public interest here in the election and the democratic process and letting that democratic process run its course. I had a misdemeanor case in this same district set for eight months in the future, not this kind of schedule. This schedule is outrageous. Nobody could prepare in this timeframe, certainly not these lawyers. It's once more, unfortunately, the political process reaching another branch of government where it has no place. And I earlier read what the code of professional conduct is for judges and this would seem to me to violate it in multiple ways. That's number one. Number two, she says it's like any other case, whether it's athletes or anything else. And yet the Department of Justice for several decades, Democrat and Republican attorneys generals have issued memos in March of election years specifically saying this is not like any other case. You better make sure that when you conduct investigations that you do not interfere with a campaign and they go further. You're not to charge people before a campaign unless you get a sign off by the attorney general of the United States himself. But they give warning after warning after warning that this is different, that you are not supposed to use the criminal justice system to affect an election. Yet we have a prosecutor and a judge who are doing exactly that. No? Yeah. Well, I don't think you got the most recent memo, which was if Trump is involved, ignore all previous memos for every other election. No, you're a hundred percent right. In my view, it violates the fifth and the sixth amendment rights. There's no possible way you hit on the most important one, the effective assistance of counsel, but also due process, all of the fair trial rights, the right to compel witnesses. He can't even sort out who the witnesses would be. They don't know what the exculpatory evidence would be. And the prosecutor said, well, they streamlined things and they've gone through and made it easier. It's not for the prosecutor to decide what evidence the defense finds most important. The defense has to do the painstaking work of going through the evidence. Listen, I've had experience with two members of a couple of members of this Mr. Smith's team. And especially in this DC process, I have right now a sanctions motion going against JP Cooney, the lead fellow in this case, and Molly Gaston in another case in this district, we're awaiting a hearing because of their outrageous government misconduct. And in that case, the judge said he's very concerned about their misconduct and he's concerned that they don't seem to be concerned, but we haven't had the hearing yet. So Trump is a speedy trial on behalf of the government, not on behalf of the defender or the public. Let's make that clear. And you have a matter before one of these judges in the same district and they can't seem to get around to it, right? Right. I've got a case actually with judge Chutkin and another judge in this district, Judge Walton, both of whom I'm sure in another setting of fine judges, but literally I've had a motion to dismiss and those are civil cases, but important cases with claims hanging over my client's head. And then literally I've had motions to dismiss pending for over three years without any action on them. Well, maybe judge Chutkin can put that in the front of her calendar and work that out. I mean, it's been sitting there for three years. Yeah, this is a railroad job. That's all it is. You're in simple.

Welcome back America. We're here with one of the finest litigators I know, Jim Trusty who used to work at the Department of Justice, also a former federal prosecutor. He's with the IFA law firm, a law partner there, and was a former lawyer for Donald Trump. Jim Trusty, you see what's taken place in Washington, DC. I've read this complaint now and there's nothing in here at all. 18 US Code 2383 about rebellion or insurrection. I thought that's what this was all about. 18 US Code section 2384 seditious conspiracy. I heard former federal prosecutors saying they have them dead to rights on that. Instead what I read is an assault on the First Amendment, an assault on attorneys providing advice who are indicted for giving me advice the government doesn't agree with. I see this really as a political statement dressed up as a legal statement here. Do you agree? And if so, how does somebody get away with this? Yeah, well, we get away from it. We get away with this because of the fact you've got an attorney general who's completely politicized the DOJ and they're carrying water for the Biden administration in a very destructive way. I mean, you've touched on it perfectly, Mark. The problem is this is creative prosecution. You know, that's the last thing you want. What you want in a situation where the stakes are this high when you're literally affecting elections and when you're literally going after a former president, what you'd want from a Department of Justice is scrupulous transparency, where they are literally willing to have anybody look over their shoulder that asks, including special masters or judges, where they are forthcoming with discovery, where they basically don't do anything that's obviously creative because the creativity shows that this is just ends justify the means. This is just a group that has decided even if we don't have the evidence that we were hoping for, we're going to come up with something. We've got the target. Now we're going to come up with the charges. And so I think if you look at these indictments, you know, it is a very bad precedent for what is considered fair game in a high-profile public integrity type prosecution. If you're a lawyer advising candidates, now you are exposed to possible indictment if after the fact a prosecutor looks back on this, could be any US attorney at this point now, any they look back and they say you know what you lied. You know what the advice that you gave to your candidate was intended to obstruct the the peaceful movement from one senator to another, one administration to another. I mean this document literally destroys the ability to get straight legal advice, it destroys the ability for a candidate to know what's in, what's out, what the rules of the game are, who's going to decide them and so forth and so on. Isn't that for Congress to decide other than a grand jury? Yeah I mean Mark, look there's a commonality between the two federal indictments, between Mar-a-Lago and now this can is you know Klein conspiracy as they call it under under the statute 18 USC 371. The commonality in these indictments is that DOJ has blown open important privileges that are held by presidents and others and so in the Mar-a-Lago case, attorney-client privilege which is almost absolutely inviolable was blown open by a friendly judge to allow for an indictment to have all these highlight moments of what Evan Corcoran said or what the exchange was between Evan Corcoran and the president about complying with the subpoena. The common thing we see in this more recent indictment is there's no such thing as executive privilege. The highlights in this indictment tend to be conversations between the vice president and the president which used to be sacrosanct. So what you're coming up with is a model for candidates or for presidents or for vice presidents where they have to know that hey all this stuff that's supposed to be behind closed doors so we can run this country is fair game for ambitious creative prosecutors and so we can't have these conversations. I mean we want to encourage frankness and disagreement between these high-level people that are running our country and these two indictments stand for the proposition that we'll criminalize it if there's a disagreement and that is the worst precedent imaginable in a case that demands transparency. It's very important what you're saying here. Attorney-client privilege was denied Donald Trump in the documents case. It was litigated in secret. We still haven't read the order that the judge issued. I assume the judge in Florida is going to have an opportunity to figure this stuff out. An emotion will likely be fired I hope by the Trump lawyers challenging all this. It's very difficult to see how you've due process when the information that you've discussed with your lawyer becomes the basic information used by the government against you. I can't think of another system like this. The crime fraud exception as we talked about it's a very very high bar so just so the public understands it's not that what if I do this what if I do this what if I do this that's fair game. The issue is when you try to get your lawyer look Frank my lawyer Frank you need to destroy those documents I insist that you destroy those documents that's the crime fraud exception not asking what happens if I destroy the documents any client is free to ask their their lawyer that sort of thing we don't know anything about this do we Jim? Yeah well I might know a little bit but look I mean there's the reality which yeah and there's things obviously I can't talk about but what I would just say is this the crime fraud exception is designed to be what you're talking about where there is cause and effect even if you even if the attorney is an unwitting in other words they're not purposefully breaking the law you have to show to a court considering that crime fraud exception that the advice was given and that the client then said oh well therefore I will now be able to break the law so it would be like hey Frank can I destroy all these documents they're looking for and Frank says yeah that would make it go away and then he destroys the documents right that would be a situation where you know you would at least have the possibility of blowing open the attorney-client relationship for that purpose I can just tell you there was nothing like that here and the bottom line is the indictment has all of these nuggets of conversations that happen every day of the week when you talk about white-collar investigations where an executive turns to his lawyer and says hey can we fight this subpoena can we do we have to turn stuff over what would happen if I do this what would happen if I do that we as a society as a criminal justice system want to encourage those types of interchanges and right now because of the desire to get one man and one man only the Department of Justice has created new law new precedent new damage to the institution of the presidency because of their pursuit of one man we'll be right back
