and join us from our on all of this as former federal prosecutor, Andrew Derkaski. So good to have you. What about that point? He says this case never should have been brought. We have looked to see if anybody else has ever been indicted or prosecuted for this. It's hard to find anything on it. Should it have never happened? Well, I think Donald Trump has two fights that he's fighting right now. One is the fight that this should have never happened. And there aren't comparable cases. And it seems like even if you had some degree of comparable cases, the amount of punitive damages that Letitia James is going for is just astronomical. And that kind of brings the second point because there is a case to make in mitigation here. Going in today to say to the judge, there is no damage. There are no complainants. Nobody lost anything here. So whatever the punishment should be, should be extremely limited. Andrew, in the state of New York, what is the appeals process like? How would that unfold in a civil trial like this? Well, after a verdict, then you have a time window open in order to file your appeals. That goes on usually for months, could last into years. Obviously, an appellate court is going to have a lot of interest in this case, and they're going to move things more quickly. We see that happen all the time with Donald Trump. But appeals can take an exceptional amount of time. The point that Dana just made is that there's no precedent that we have found for the state of New York to put somebody on trial and convict them for misstating the value of the piece of property, okay? This is the first time. If it were to reach the New York State Supreme Court level, is that Republican? Is that Democrat in a blue state like New York? What is the breakdown? Well, you're largely looking at Democrat judges in the state of New York. At the end, what they're going to be looking at are two separate things, abusive discretion or plain error. Those are the standards that you're talking about in appeals courts. And so the different legal issues and factual issues at play, at each stage of appeals, the Trump team will bring those up and seek their relief. They haven't found much favor from the appellate courts yet. I want to play this for you. So we were watching the courtroom, so the president has spoken, so I don't think you're going to see him again. We'll keep an eye on that. The Tisha James is an interesting person, right? So she campaigned initially on this. She's been pushing forward. She's in the courtroom every day. She's making sure she's in that camera shot. And she had planned this for a while. Let's watch here. Call for number one. The president of the United States has complained that I'm engaging in some sort of political witch hunt, that I've got some personal vendetta against him, that I campaigned against him. That is not true. I look forward to going into the office of attorney general every day, suing him, defending your rights, and then going home. We will rise up together, and we will resist this president, and ultimately we'll bring him down. What do you make of that? She's a politician, and she's running a campaign, and she's continuing to deliver on the campaign that she ran. So what we see when we see Donald Trump in court now is her looking for astronomical damages for something that banks had an opportunity to investigate. If a real estate agent tells you your house is worth a million, you list it for 1.5, and it sells for two. What was the house worth? I mean, that's the sort of thing that Trump is looking at at the end of the day, trying to make a case that he was just doing business. He was being a businessman. And they made the case that nobody suffered damages here. The banks were fulfilled. They were happy with the loans they made, et cetera. Apparently there was an email exchange yesterday. They were trying to postpone today's hearing, in part because Melania Trump just lost her mother and the former president wouldn't go back to Florida to be with his family. I just want to put it on screen here. I don't have it on paper. And this is what lawyers said with the judge, "I won't debate this yet again. Take it or leave it. Now or never. You have until noon. Seven minutes from now, I will not grant any further extension." So that's from yesterday. It didn't happen. Is that par for the course or not? Well, it's been par for the course throughout this entire trial. I think one of the things that's most important in any trial is that a judge appears to be fair and unbiased in what they're doing. And there are serious questions about that in this case where the judge effectively ruled on a matter of fact before the trial ever took place. There's been hostility throughout. Certainly Donald Trump has had hostility towards the judge and towards the court throughout the case as well. So when the judge in the last minute continues to just all caps and that sort of message, it doesn't feel fair, I'm sure, to Donald Trump or to his supporters. Are other real estate tycoons or even investors in New York worried about the outcome of this case? I think every business person in New York should be worried about this. The idea that you are negotiating with other companies, with banks, with lending institutions, the way that that comes out and how you trust certain people in your team and what they say the value is. For example, my example about the real estate agent, it's a very difficult thing to dance through and then all of a sudden political opponents attack you. I would say just a couple more things here. Put number two up, guys. These are the properties we're talking about, primarily New York City, but also New York State. We live here. These are substantial properties. We can say that and agree on that. Absolutely. And they want to find him $370 million. What they want to do is take him and his kids out of New York State entirely and forbid them from doing business here. Yeah. Can you do that? You know, constitutionally, we talk about life and liberty. Liberty is typically this idea that you have the right to work, that you have the right to create your fortune. Donald Trump being stripped of his right to do business in the state of New York, to be stripped of these properties, that is a tremendous consequence. It is something that is just shy of going to jail. It is something that I think we should be looking at with a great degree of skepticism where he doesn't have a jury, where the judge is reaching decisions pre-trial. These are concerns for the state of New York and the people who do business here.

So let's talk about one thing that the press hasn't reported. We just listened to testimony from a man who has such distinct recognitions as an accounting expert that even Letitia James's team and the OAG's team used him themselves as an accounting expert. Professor Bartov was the New York Attorney General's expert in the Exxon case. Let's start there. But today, when he was on the other side, they spent the entire day objecting because he was giving testimony that didn't suit their claims. His testimony included that there was absolutely, and I quote, no fraud, that the statement of financial condition for President Trump was understated, that there was no evidence of concealment, and that in fact, President Trump's statements of financial condition had something that most other statements of financial condition don't have, 18 pages of descriptions and details about his properties, about his trophy assets, things that most people don't need to do and wouldn't do. The reason, because he had nothing to hide and he didn't conceal anything. This is not a publicly traded company. This is a private company. And the Attorney General is now sticking her nose into private companies. This is a very scary moment for our country. We have to have boundaries. We have to have laws. They were objecting every five minutes, and I really give credit today to the press that was in there. I did look at some of the feed, and it was accurate. There was absolutely no fraud. The statements were undervalued, and President Trump and the Trump organization provided Deutsche Bank with everything they needed. Last week, we heard banks make clear that they thought they were a trophy client. They were the big whale that they wanted to get, and they valued their relationship. They said that holds true today. I don't know why we're here. I've said it before, and I say it again. Again, this case has absolutely no merit, and you don't have to believe me. A man that gives the Nobel Executive Committee recommendations on accounting, and who should be recognized in accounting, that man that just sat in there for the entire day, made it very clear, and had words with the AG and said, "You should be ashamed of yourself," and I say it too. "You should be ashamed of yourself." Thank you. I'm not going to speak about privileged information. At this time, the president is looking forward to taking the stand and once again making clear that he cooperated, he performed on his loans, they were paid ahead of schedule in some instances, always on time, and he was never in default. But somehow, Ms. James needs to fulfill her political promise, so we're here, and he'll be addressing all of that on Monday. Don't forget, though. What's going on on Monday with the judge's gag order still in place, so he can't speak about certain things. He has to be so careful. That is so unconstitutional, in my opinion. We have First Amendment rights, we have rights as attorneys, Sixth Amendment rights, and those are all being violated. And he still wants to take the stand, even though my advice is, at this point, you should never take the stand with a gag order, but he is so firmly against what is happening in this court and so firmly for the old America that we know, not this America, that he will take that stand on Monday. What can we expect on Monday? The same as we've heard, the same as we've heard from experts. He will clarify it. He will open himself up to whatever they want, because he's not afraid. People that are afraid cower. President Trump doesn't cower. We'll be back on Monday. With that, and tomorrow, we'll hear more testimony from this incredibly intelligent man. What is your policy's reaction to the testimony today? I think he made it clear. It's more frustration that we have wasted time, that they are doing election interference. This is a tactic that we've seen time and time again. This is not the first or last of it, and we're going to have to deal with it in all the other trials. But I really hope this is a lesson to those other AGs and DA's out there, trying to make a name for themselves off of President Trump's back. If you're going to do it with garbage claims, it's going to come out, because there are experts willing to put their heads out, willing to put their necks out, and willing to say that this is garbage. And we heard that today the entire day, and we will hear that well into tomorrow. I don't speak about politics. I'm a lawyer. But with all the cases that are stacked against him, we still feel confident about one day of the outcome of this case, and everything that is. The outcome of this case was determined before we walked into court. Let's be clear. We're not walking into this court every day expecting that this judge is going to let us off. We already see what's happened in this court. This judge made his determination on summary judgment before we even walked in before an expert took the stand. So let's not get it twisted. I'm not here fighting for that. I'm here fighting for America with him, so that we can stop this. You know, that's the truth of it, and it's a very sad state of affairs today, and many days we've asked for a directed verdict because there is no case. This case is garbage. Thank you.

All right, so in the left's latest Trump witch hunt, Radical New York Attorney General Letitia James, who campaigned on going after one man, Donald Trump, one family, the Trump family, one organization, the Trump organization, is now claiming that the Trump organization, in fact, inflated the value of its assets in what is a big fraud scheme. Now, at the center of this trial is an insane ruling from a judge claiming that Mar-a-Lago in Palm Beach, that its real value is only $18 million. All right, let's do a quick one-on-one on Palm Beach real estate. Look at this here. We got a two-acre wooded lot on the ocean. There's no building on it at all. Five minutes away from Mar-a-Lago, listed for a whopping $150 million. You got another empty lot nearby. 2.3 acres on the ocean, listed for $200 million. Look at your screen. Mar-a-Lago is a 60,000 square foot, 58 bedroom, 33 bathroom, mansion, historical location, as such, with two clubs located on 20 acres of prime Palm Beach real estate with a unique position in that it has property on the inter-coastal side and on the ocean from side with a club associated with it. 20 acres, okay. Now, this is what the judge wants you to believe is worth, let's see, over $100 million less than a wooded lot of two acres, you gotta be kidding me. Now, remember, every contract that the Trump family was involved in with real estate and applying for loans and dealing with insurance companies, lending companies, okay, they would tell, they had language in this contract that said not to use their appraisals, but they had to use their own appraisals, that it would be their fiduciary responsibility to come up with what they believe the real value of a property happens to be. And by the way, not one bank, not one insurance company ever filed any complaint. Everyone was paid on time. Now, if this isn't hypocritical left-wing politics that is worse, I don't know what is. Here with reaction, Trump legal spokesperson, Alina Hoppe is with us, the author of the Constitution of the US and other patriotic documents, Fox News legal analyst, Greg Jarrett. Now, Alina, I don't wanna put you in a position, I understand a gag order is in place, but I do wanna talk about real estate down in Palm Beach. I know a thing or two about it. And I've talked to a lot of realtors, they're laughing at this. So the allegation is that the Trump organization was artificially inflating numbers to get more favorable loan terms and more favorable insurance rates, okay. The judge is claiming that a property, according to realtors I spoke to, is kind of close to a billion dollars and he's sticking with 18 million. Now, doesn't that make him guilty of the very thing that they're trying to claim that the Trump family did? - It does and I think that we should look at anybody that's taken a property and their tax assessed value, which is by the way, what he thinks the property is now worth. The $18 million is a tax assessed value. So if you actually were going to sell it and I know you're familiar with the property, so am I, you probably could maybe sell half of a tennis court here for $18 million given where it's located and what it's worth. The statement of financial condition for the president, for the company was undervalued tremendously. If the president had put his brand alone, the brand of Trump, which got him elected to office, that brand alone would quadruple, triple, double, whatever the number is, the statement of financial condition. This is insanity and the fact, frankly, that I can't speak freely is insanity in and of itself. So we're really in a banana republic. This is political law fair, not warfare, and I'm sitting front row for it, it's unfortunate. - So Greg Jarrett, just common sense and logic needs to prevail here. So you got 20 plus acres on the inner coastal and on the ocean side. You got a club, you got this massive building, it's historical, many, many bedrooms and bathrooms and everything in between, and it's a club on top of it. And meanwhile, a two acre parcel of ocean from property in Palm Beach is gonna go for 200 million, but that 20 plus acre property is only worth 18 million and the judge is sticking by that valuation with a straight face, you gotta be kidding me. I mean, this can't be, this really can't be happening in this country, but it is happening. What do you make of it all? - Well, it shows how biased the judge is, determined to find that Trump's liable at trial, but the good news for them is, Sean, I doubt that any of this will ever stand up on appeal because this executive law being used against them completely undermines more than a century of established common law that requires proof of intent to deceive in civil fraud cases that somebody knowingly made false statements. But this poorly conceived law simply does away with all of that and punishes somebody for making inaccurate statements with no intent to do so, sort of like prosecuting a customer for robbing a bank because the teller gave out the wrong change. This law also violates the Constitution, Sean, it penalizes inaccurate commercial speech, which the First Amendment protects. But you know, under Letitia James, anybody can have their business taken away from them by her if they happen to misstate without negligence or intent assets that are used to secure loans, even if the business owner relied entirely on professionals to do the valuations, which the Trump organization did. - I'm not sure whether Alina can answer or not, and I don't wanna put her in a bad spot here, but you do have an AG that ran on a platform to go after one man, Donald Trump, one family, the Trump family, one organization, the Trump organization. Alina, to the extent you can, you can weigh in, Greg, you can weigh in, you know, to me, there's something so fundamentally wrong about that, running on a campaign and now fulfilling a campaign promise, Alina? - That's 100% wrong. It's political interference, it's political persecution, prosecution, and it is something we've been fighting, and I'm happy to speak freely about it. Ms. James has gone outside and showed up, Sean, only on the days where it was headline days, only on the days where the president is there, where the kids were there. She wasn't there for the past few days. She thought they were mundane, evidently. But the other day, she's sitting there while the city is going to hell. And we are watching something where the statement of financial condition was frankly undervalued, where there was, you know, a disclaimer on the front page with sophisticated lenders saying, you need to do your own due diligence, but nobody is paying attention to the glaring fact that you just brought up. Ms. James is doing this for political reasons. She does not care about New York. She does not care about businesses doing well. She is doing it so that she can make money, so that she can run. And you know what, frankly, it's backfiring in her face if you look at the polls. - You know, and you gotta think about, this is the state, Greg, and we only have about 20 seconds left, that has no bail loss. Not one insurance company that I've heard of or read about, not one lending institution. None of them complained. Why is this even in court? - When she ran for office on the campaign promise of "getting Trump," she was violating the ethical standard that governs prosecutors, she had no access to any evidence, any investigative files, she committed herself publicly to getting a specific individual, and then she misused the power of her office to manufacture a case against him. That's the sort of thing for which she should be disbarred. - We're now criminalizing political differences. That's a very dangerous place for any country to be.

Why are we trying a case that the Appellate Division of New York State has just ruled recently that we won 80 percent of our case? And this judge refuses to acknowledge the ruling, which is very plain for all to see. We won, as you know, it had to do with Ivanka, and it had to do with other things. It had to do with the statute of limitations where they wanted to go back to 200 years ago, 500 years ago. It was limited, very much limited, and it amounted to about 80 percent of the case was won by us in the Appellate Division. And this rogue judge, a Trump painter, the only one that hates Trump more is his associate up there, his person that works with him, and she's screaming into his ear on almost every time we ask a question in disgrace. One other truth that's in disgrace. So, this rogue judge refuses to acknowledge the fact that we won 80 percent of this case in the Appellate Division, including statute of limitations.
