No way it would not have happened. And do you really think that in the Hague we would have come to the 5% commitment without president Trump? No way. So when president Trump is doing good stuff, I have operation, uh, and I don't mind him, uh, publishing text messages. And if anyone thinks here again, that the European union or Europe as a whole can defend itself without the US, keep on dreaming. You can't, we can't. We need each other. And why do we need each other? I tell you, first of all, because also the US needs NATO for the US to stay safe. And by the way, Arctic region is evidence here. They need a secure Arctic. They need to secure your Atlantic. And you also need to secure Europe. So the US has every interest in NATO as much as Canada and the European NATO, uh, NATO allies, but for Europe, if you really want to go with alone and those who you are planning for that, forget that you can never get there with 5%. It will be 10%, you have to build up your own nuclear capability. That costs billions and billions of euros. You will lose them in that scenario, you would lose the ultimate guarantor of our freedom, which is the US nuclear umbrella. Uh, so, Hey, uh, good luck.

Many days after Kevin McCarthy was sworn in as speaker, did you subpoena his records? I don't recall, but those two things had nothing to do with it. It was 16 days after becoming the highest-ranking Republican in the House of Representatives. You subpoenaed his toll records. Do you agree that that might reasonably be considered a violation of the speech or debate clause? I do not, and I want to be clear that the toll records— We were collecting months' worth of phone data on the Republican Speaker of the House, the leader of the opposition, right after he got sworn in as speaker, all around the time of a major vote. That sounds like a flagrant violation of the speech or debate clause to me, and I think most people agree with me. And Speaker McCarthy had no recourse, did he, because you issued a non-disclosure order ensuring that neither he nor any of the American people knew about these subpoenas. Is that right? The toll record, the non-content toll record subpoenas, we did secure non-disclosure orders for those subpoenas. You did, and let me ask you, Mr. Smith, at the time you secured those non-disclosure orders, was Speaker McCarthy a flight risk? The non-disclosure order was based on concerns about— Was Speaker McCarthy a flight risk? He was not. He was not. Then why did your non-disclosure order refer to him as a flight risk? It says right here, "The court finds reasonable grounds to believe that such disclosure will result in flight from prosecution." Sir, when securing a non-disclosure order, the risks don't have to be associated with the— Do you think the Speaker of the House is a flight risk? Did he finish answering the question? No, this is not your time. This is my time. You think the Speaker of the House is a flight risk? Do you think he's going to hop on a plane and leave the country? No, what I was trying to explain is with respect to a non-disclosure order, the risks aren't necessarily associated with the subscriber to the phone. There are risks to the investigation. I think that you were using—this was clearly in reference to Speaker McCarthy, and you were using clearly false information to secure a non-disclosure order to hide from Speaker McCarthy and from the American people the fact that you were spying on his toll records. But I've got more, so let's move on. In May of 2023, you also issued subpoenas for toll records of nine U.S. Senators and an additional representative. Is that right? In May of 2023, we did issue— You did, and there were non-disclosure orders in conjunction with those subpoenas as well, right? That's correct, consistent with Department policy and the law. So again, nobody would know what you were doing. The Senators would, and the Representatives would, and the American people wouldn't know what you were doing. Is that right? The toll records that we secured and the non-disclosure orders were consistent with policy and consistent with— And you knew, whenever you were doing that, that there was a risk you were violating the speech or debate clause. Is that right? The toll record subpoenas that we secured were with the concurrence of the public— Your own analysis says that you knew there was a risk you were violating the speech or debate clause. I have it right here. It's an email from John Keller at public integrity section to your team. As you are aware, there is some litigation risk regarding whether compelled disclosure of toll records of a member's legislative calls violates the speech or debate clause in the D.C. Circuit. That's from your own analysis right there. So you did know, didn't you? So with respect to the item you just put up on the screen, the last sentence states— We're going to get to the last sentence. We're going to get to the last sentence. And you cite case law in here, quote, "The bar on compelled disclosure is absolute." Is that right? Or do you think that you didn't have to abide by that precedent? To be clear, this is not—this statement is not from my office. This is the statement of public— This is your justification for those subpoenas and NDO's that you ordered. This was part of your analysis. It's a cursory analysis. I think it's worth noting. But let's get to that last sentence then. Quote, "Given my understanding of the low likelihood that any of the members listed below would be charged, the litigation risk should be minimal here." In other words, you're using a novel legal theory, which you knew was novel, has never been tested by any court. You're not charging any of these members. Nobody's going to know about it because you issued NDO's. Nobody's going to sue about it, so sue this. So who cares? We're going to do it anyways. You walked all over the Constitution throughout this entire process, buying our members of Congress, and you know it. - It's absolutely disgraceful. - The time.

joining me now to break that news, as he always does, is my favorite John Solomon, founder of Just The News. John, first of all, before we get into their latest and greatest, what is ActBlue specifically? It is the largest Democratic online fundraising machine in America. It moves hundreds of millions of dollars of small donations, online donations to Democrat and liberal causes, every election cycle. It is the juggernaut of the Democratic fundraising machine these days. I remember when we had Hurricane Harvey down in my neck of the woods in Houston, and Democrats famously fundraised to help those hurricane victims, and instead the money went to ActBlue. That's just how these people operate. Now, what's the latest and greatest? Well, there have been three investigations ongoing. There's one in the Senate, one in the FBI and Justice Department, and then one in the House. Yesterday, the House, three separate committees of the United States House of Representatives, the Judiciary Committee, the Administration Committee, and the Oversight Committee sent a letter to ActBlue saying, "Hey, we think you misled us. We think you've been lying about this, and we're going to bring you in for further depositions." Now, as part of that, they also released a report. The report said that all of the legal compliance officers for ActBlue, the lawyers who were supposed to keep ActBlue out of trouble, all took the Fifth Amendment when being questioned about the various practices designed to keep illegal foreign money and excessive donations from moving through the platform to Democrat and liberal causes. That is not a good sign if you're ActBlue, if you're lawyers, lawyer up and take the Fifth Amendment. The third element of that is that the report hinted at some pretty significant transactions. ActBlue became aware at various times that foreign money and other illicit transactions were coming through their platform but didn't tighten up their fraud prevention tactics. In fact, they did the opposite. They downgraded their fraud prevention tactics, almost seeming to enable fraud to occur on the platform easier. One of the things they got rid of and didn't use for most of the 2024 election campaign, that little three-number code that you have in the back of your credit card, that's probably the biggest, the CVV, it's called, the biggest fraud prevention opportunity that everybody has. If you don't have the code, you don't have the card, you're not the person. For some reason, ActBlue got rid of that for a long period of time until they were called out on it after a series of stories by Just The News in the summer of 2024. That was a really red flag. And if that isn't enough to make you suspicious about ActBlue, yesterday, the Attorney General of Texas, Ken Paxton, sued ActBlue saying that they had misled the state in its investigation and that they likely engaged in improper fundraising in the state. So there is a world of hurt surrounding ActBlue this moment. And meanwhile, donations on ActBlue look to be a little bit down this year compared to prior years. Okay. So you would know this much better than me. This sounds complicated, as in this sounds like something that's going to take a while to unravel and expose. And if people were expecting ActBlue's CEO, whoever that may be, to go to prison tomorrow, they're going to be sorely mistaken. Well, I think there's one issue that is very prescient and very time-sensitive, and that is that a couple of weeks ago in a New York Times article, a letter surfaced from the law firm that was representing ActBlue that made clear that ActBlue's own lawyers believed that ActBlue had misled Congress, had made a false representation or statement to Congress. That's not a hard case to bring. If that is true, and if the lawyer's evidence becomes part of that case, that could be a profound and quick potential prosecution. And then you might take that act as a prosecutor because you want to roll a person up or a couple people up to get them to cooperate against the larger enterprise. So I'd be watching for that part of the case to bubble up. Meanwhile, I think Casper Dell dropped a big bombshell in the Maria Bartiroma Sunday show. He said that the election meddling allegations are now part of the grand conspiracy case, the one that's looking at Russia collusion as election meddling, Ukraine impeachment as election meddling, the raid on Donald Trump's house in Mar-a-Lago as election meddling, and of course Jack Smith's antics before the '24 election. The fact that he said that now election integrity issues are part of that is a big, big shift. That is the first time we've heard that, and it appears to be that ActBlue is part of that election cheating, election concerns that are being investigated. It doesn't mean it happened, but that's clearly what they're looking at. Did they allow illicit foreign money or excessive donations to come into? So DOJ looks like it's got a hot iron right now. I think the nearest case, if they do make one, and it doesn't mean that the evidence will show this, but if the lawyers for ActBlue are telling the truth in that letter, ActBlue could have a charge of misleading or obstructing Congress come at it pretty soon. That'd be wonderful. Speaking of cash Patel, here's what else he had to say. I am never going to let this go, because they not only have personally attacked the presidency of the United States and President Trump, but they tried to thwart our elections and rig the entire system. And that is not something that is going to stop on, that is not something I'm going to allow on my watch. But you have to remember, they built this disease temple over 20 and 30 years. We've got all the efforts I can announce on your show that we've got all the information we need. We're working with our prosecutors at Department of Justice and Attorney General Todd Blanche, and we are going to be making arrests. And it's coming, and I promise you, it's coming soon. John, who? What? What's happening? Yeah, these are great questions. So let's remind everybody what I broke on Saturday, that Joe DeGeneva, former U.S. Attorney, former special counsel, former independent counsel, one of the few lawyers in American history to hold all three of those ties. He's a very accomplished prosecutorial lawyer. He just took over the grand conspiracy case in Fort Pierce, Florida. That is some heavy artillery if you're talking about a prosecutor who knows what he's doing. There are two cases pending right now. There's a case looking at whether John Brennan misled and obstructed Congress and whether James Comey lied and obstructed to Congress. There's been new evidence presented. The Brennan case has been tied up a little because the Senate, the John Thune Senate, the place where action goes to die, or as I like to call it, the grand old party of procrastinators, GOP, grand old procrastinators, they haven't yet complied with the request that came in back in January and February for the Senate to transmit certain evidence to the grand jury. But if John Thune can get that done, it will become a very important part of the case. And I think the decisions on whether to indict Brennan and Comey could be made in the next few weeks. When you saw Maria Bartiroma, the next question she said is, is it going to be in the next couple of weeks? And Cash Mattel said, yeah, I think so. That's consistent with what I've been hearing. There always can be a delay here and there. But I do think this spring the first decisions on who should be indicted for weaponization are going to be made down in Florida. Do you have a piece out, speaking of all this stuff, about intel agencies, the 2020 election, having, what did they say, vulnerabilities? What is all this? Yeah, it's an important piece of evidence. And you have to put it together with two or three other things that I've kind of squeezed out of the DNI in the last couple of months. And by the way, I want to thank Tulsi Gabbard personally for considering the specific requests I made for documents and declassifying them. She did that on her own. And it's a great act of transparency. We fight with government a lot, but she's been fantastic in getting us documents we've identified in our reporting that we believe are of national interest. Today, I want to remind everybody what we were told in December 2020 when Donald Trump was crying foul about the 2020 election. We were told it was the most secure election in American history. That is what people said on the record, on television, on camera. We now know that that was not the case. Another false narrative concocted by the bureaucrats in government, just like Russia collusion, just like Ukraine impeachment, like just all the other things that we've been talking about. We now know that China and Iran had hacked into the voter registration databases of multiple states. Iran at least won China multiple states. We were never told that. That is one of the largest breaches in American electoral history. We still don't know the names of all the states, though I'm now beginning to be told it's more than a dozen. So it's a massive breach. It's been kept secret for six years. It's only because Tulsi Gabbard's digging into this and Cass Patel's digging into it that we're now getting visibility. So we broke that story a couple of weeks ago. And what we broke this morning is the precursor warning that the intelligence community knew at the start of the 2020 election, in January and February of 2020, that these systems were vulnerable. Specifically, they flagged the voter registration data. And they described how a foreign power would likely use that data if they got it. They would file false ballots. They would potentially knock people off the voter registration list. They would assume identities and do influence operations on social media. That's exactly what would happen just three or four months later. The CIA, the FBI, the NSA began detecting evidence in the spring of 2020, just a few months after that document that made public today was written that China and Iran had done that. Iran stole 100,000 voter identities and used them for ballot influence operations. China, we believe, reached more than a dozen states' voter registration databases. And then we know, because of documents Cass Patel made public recently that we wrote and broke about, that the Chinese sent tens of thousands of fake driver's licenses to the United States in the summer of 2020. So they breached the databases. They get the identities. They send fake driver's licenses. And according to the FBI documents, their goal was to get ballots. The Chinese were going to get ballots and vote in the names of Americans, and try to swing the election to Joe Biden. That's what the FBI documents say. All of that was kept from us for the last six years. And certainly those records that are now out in public do not equate to the most secure election in American history. We were lied to. Final one for me, John, and it's a fairly important one. Do we know who kept that information from us at, say, the FBI? Because that's kind of a big deal. Yeah, listen, we know from the documents I got a few weeks ago that the FBI originally wanted to put an alert out and did quickly put an alert out when the driver's licenses were captured. They were stopped at an airport, and the FBI had a very reliable informant in China saying this was a plot to help Joe Biden. Within 24, 48 hours, their supervisors in the counterintelligence division ordered them to recall that report and destroy it. I want to repeat what I just said. They said don't pull it back from all the agencies you just sent it to and instruct those agencies to destroy the document. That sounds like a cover-up, because by the way, the evidence is held true to this day. They've re-vetted that informant multiple times. They have considered that informant to be reliable. And by the way, the government has in its possession the fake driver's licenses. They intercepted it. So it was a real plot. When it comes to Ukraine and the stuff we broke last week, we know it was the Inspector General, Michael Atkinson. When it comes to FBI documents, there's a heavy focus on the seventh floor, the leadership of the FBI at Chris Ray and people downstream from him. And also, there's a growing body of evidence, particularly in Arctic Cross, and there was a hearing today in the Senate, that the Washington Field Office, which is the second most prominent local office in the FBI after New York, those are the two big ones, that they have been involved in some really nefarious things in targeting Trump supporters without cause, without having a predicate or criminal case that made sense. And so those are the players. We're going to get more names as more documents get declassified. I think in mid-May, Tulsi Gabbard is likely to drop a giant bombshell showing just which states were breached by China, which voter data was compromised by China. Those states have never been told this will be an alert to those states, but think about what it might do in the Senate. Right now, John Thune can't move the Save America Act through the Senate. But maybe if some of those senators found that, hey, your state, your constituents, your voters were compromised by China in 2020, and you were kept in the dark for six years, maybe there would be some momentum in the Senate. We'll have to see how that plays out.

I don't care about the Democrats. The Democrats hate our country. The Democrats are in chaos right now, and they have no common sense. You know, they have one quality that's amazing. They stick together. And it's harder because they stick together a ridiculous policy like men playing in women's sports, open borders for everybody, including murderers and anybody else that want it. We're open to you. Come in, murderers. You know why they do that? They do that for a couple of reasons, but they do it for votes because they think they're gonna vote for the Democrats, even though I did great with a Hispanic vote, tremendous with Hispanic vote. You know, I turned that whole thing around. The Hispanics like me and I like them. And you know, it's interesting with Hispanics. When I built the wall, everybody said, oh, that's gonna ruin us for the Hispanic. It was just the opposite. They know all about immigration, and they know all about death and crime, and they're smart people, and they have common sense. They wanted to be protected from the people that were coming into our country. So you know, I won the election with a very tremendous Hispanic vote, and I think it's higher now than it was then. So we're a party of common sense. The Democrats are a party of insanity. They're a party that will destroy our country. If I didn't win this election, I believe our country would have been destroyed by now. One year, this order would have taken. If you had Kamala or a sleepy Joe, either one, it wouldn't have mattered. They're the same thing. Two sleepy people, two stupid people. I believe, and by the way, Gavin Newsom, who is one of the candidates, I believe he took himself out of the running when he says he is, he suffers from mental disability. And a reporter said it was terrible that I talked that way about somebody with mental disability. I said, no problem with it, but I don't want a person with mental disability to be my president. I mean, you don't want to have a person with mental disability being a president. And Gavin Newsom said that he can't read a speech. He can't do almost anything. And then he said he's as dumb as all the people in the room, and he got accused of being a racist, which was an amazing set. I thought it was the worst interview I've ever seen anybody give. He's actually a very stupid person. So I believe he's out of the running. I think that that statement, that interview, he admitted that he's a stupid person. I don't want a stupid person being president. You know, I'll say it right now. I say it because no press ever reports it. I'm the only president that ever took a cognitive test. I took it three times. It's actually a very hard test for a lot of people. It wasn't hard for me, but it's a cognitive test starts off with an easy question. And by the time you get to the middle, get suffered by the time you get to the end, very few people can answer those questions. You get very tough mathematical equations and things. I took it three times. I aced it all three times in front of numerous doctors that I have no idea who they are. And I was told when I went in, I said, Doc Ronnie told me this. My current doctors were fantastic doctors. They said, Well, if you take it, you know, it's Walter Reed. It's essentially a public hospital. And if you do badly, it's probably gonna get out. But I aced it. I got them all right. And one doctor said, I've never seen anybody get them all right. I've been doing the test for 20 years. I want people I would love to see anybody that's a president or a vice president or anybody that has any chance of being a president. I would like to see them take a cognitive test because we had a man in this office that had no clue what was happening. And let me give you a little secret. He wasn't a smart man 30 years ago. I'll tell you about President Obama. He wasn't a smart man either. I know all about him. He wasn't a smart man, highly overrated. He was a great divider. And our country can't go through that anymore. Can't go through. We have done an amazing job. I had to do a little stopover. I call it an excursion. I had to do a little stopover in Iran and we had to knock the hell out of him because our country would not have been safe. The world wouldn't have been safe. I've done a great favor for the world. The world has not been. It has not been reciprocal because when I told NATO where we give millions and billions of dollars, trillions over the years, I said, Do you mind coming up and giving us a little hand with the streets? All right, let's start with this, a federal judge, again, blocking the postal service from implementing President Trump's mail ballot rule ahead of the midterms. Case could be appealed back to the Supreme Court. Of course, earlier this week the Supreme Court ruled that President Trump's effort to try to clean up the voter rolls was valid by using the post office to make sure that ballots are only delivered to actual voters who should be voting. Yeah, so this is basically a tracking system. Every company like FedEx and Amazon use these, and it's just a way of making sure that the person who's sending in the ballot is actually the voter because we know there's widespread fraud with, we know hundreds and hundreds and thousands of people are cheating, and the Democrats don't want it. They don't want to stop the fraud. Yeah, no, it is kind of amazing because I remember just a year or so ago, or a few years ago before COVID, Democrats, one thing that they could all agree upon was that the problem with mass mail-in balloting is that you have no control over who gets the ballots, you have no control over ballot custody. It was agreed that it was too dangerous because it's too fraught for corruption, but now it's become part of the Democrat strategy, apparently. Of course, and by the way, as you know, we just had new evidence that came in that hundreds and thousands of people across the country are cheating on this, and the Democrats don't want to stop it. Okay, next up, it is the year 2026, and Democrat politicians are still tearing down statues Democrats in Virginia, led by Virginia Governor Abigail Spanberger, who is the most unpopular Virginia governor in the history of polling, quietly took down the statue of a Civil War doctor, Hunter McGuire, from the grounds of state capital and Richmond. And what I think is so interesting about this abomination and attack on history is that Hunter McGuire was famous for being a Civil War doctor who revolutionized the way doctors and nurses are treated in wartime, protecting them so that they can do their jobs, helping people who are wounded on the battlefield. And his ideas later became the foundation of the Geneva Convention rules governing how medics and nurses are treated on the battlefield, yet Virginia politicians led by Abigail Spanberger tore down his statue because of their hurt feelings. He's a hero. This guy's a hero who has saved lives, potentially hundreds and hundreds of thousands of lives, relieve pain and suffering on the battlefield. And he deserves a medal. He deserves a statue. I'm proud as a person who's lived in Virginia that he was a Virginian, and yet because he has some connection with the Confederacy, they want to take it down. I mean, look, you know this. You lived in Virginia. They want to take out Thomas Jefferson, James Madison, anyone who is associated with our founding.

I've come in with great concern about how this institution, this great American institution has been run and how American taxpayer money has been handled. Could it be that you and your colleagues have returned the calls but the people calling just didn't like the answer? Could that be a possibility? I'm not aware of that. Just give me the money and I'll develop the plan later. Correct. And now you're going back through, not money that's already been contracted, but you're going back through and checking each one of these loans and these grants to make sure there was no stealing, aren't you? We are. We are. Make sure there was no incompetence, aren't you? Is that correct? We're looking at that, and yeah, my blood pressure is rising right now, just thinking about what we have seen and what did happen at the Department. And you're going to tell some of these boondoggles no, aren't you? That's correct. And they're going to be upset, aren't they? That's correct. And they ought to be upset, shouldn't they? I don't think they should be upset. I think they should be ashamed. I am. It's rare that I'm speechless, but I want to be sure I understood the people running the Department of Energy for President Biden's administration shoveled 93 billion dollars, not million, 93 billion dollars out the door in 76 days. And it just happened to be the time between when President Trump was elected and President Biden, their boss was leaving. Is that right? It is correct and distasteful confidence undermining. My God. Look, I hope you take whatever time you need to go through all of these projects penny by penny. I mean, I've heard this testimony today. Well, it'll cost jobs in my state. If somebody steals 50 million dollars and goes and spends the money in their state, that's going to stimulate the economy, isn't it? Yes, it will. But that's still stealing, isn't it? And it's still illegal, isn't it? Yes. I mean, they were spending money at the Department of Energy like it was ditch water. Their budget went from 60 billion dollars to 160 billion dollars since fiscal year 2021. It just sounds to me like there were a lot of people coming to the Department of Energy who had all four feet and their snout in the trough. And I hope you'll turn down the boondoggles and refer the thieves to the Department of Justice. We will indeed. Senator, the one complication in there too is mixed in there are good companies doing good things honestly with credible plans. And you're trying to separate the wheat from the chaff. Yes, that's what we're trying to do. That's our job. And we're doing it. But there's a lot of chaff.

President Trump has single-handedly toppled Maduro, freed the people of Venezuela, and secured the greatest boon for America's energy and supply chains probably in the history of our country. He's taken the fight to the drug cartels, declared them a foreign terrorist organization, used military power to fight these enemies of human civilization. And as you have mentioned, he stopped Iran, the Islamic theocracy of Iran, from obtaining a nuclear weapon that could destroy an entire city. And now he'd come at home. He's unleashed American energy. He's building pipelines. He's bringing the price of gas down from the heinous highs of the Biden administration. He's taken inflation from the highest level in American history down to 2%. The largest tax cut in American history, no tax on tips, no tax on Social Security, no tax on overtime. And he took the most unsecured, dangerous, violent, hellish border in the history of our republic and 15 straight months, Sean, of zero releases, zero into the country.
