(upbeat music) - Will Scharf is a real former federal prosecutor and he's running for attorney general of Missouri and he'd be a great attorney general in the Show-Me State. By the way, they may wanna change that phrase, Show-Me State these days, it could be misinterpreted, but that's a whole 'nother story. Okay, Will Scharf. Espionage Act, Presidential Records Act, how do we make this simple? We have a former attorney general who's all over television saying, "No, no, no, it's the Espionage Act," and can you tell me any other former president who's been charged under the Espionage Act since 1917? Do you have one? - It's never happened before and this is a controversial act to begin with. A lot of free speech advocates think it's unconstitutionally overbroad as written. Certainly as it's being applied to President Trump here, there are real legal issues with the way that they've brought this case. Jack Smith, the special counsel, wants America to think this is a very simple open and shut case. They found documents at Mar-a-Lago and therefore President Trump is guilty, but anyone with a passing familiarity with the law here knows that that's just not the case and that's why it's so important that we fight back against the dominant mainstream narrative here. - Why is it at the case? - So under the Presidential Records Act, when a president leaves office, he has the right to determine which of his records are presidential records, official documents, that sort of thing, and which are personal records, items of a personal nature, diaries, journals, memorabilia, items that are of personal importance, not official importance. That determination by the president, courts have said, is essentially unreviewable. Now in order to prove an Espionage Act count, it's not enough for them to show that President Trump had some documents. They have to show that President Trump knew that he wasn't supposed to have those documents. They have to show that he knew that those documents were a particular type of documents called national defense information. They have to show that he then willfully failed to turn those documents over to a government official that he knew had the right to receive them. So when you take all of that put together, this case is really more about President Trump's state of mind than anything else. And I think that when you look at the president's responsibilities, duties, and rights under the Presidential Records Act, it's going to be very difficult, if not impossible, for Jack Smith to prove that President Trump had documents he knew he wasn't supposed to have and that he then willfully failed to turn those documents over to an official he knew he had to turn them over to. -And he's publicly said over and over again, "I've declassified this." And your point is it doesn't matter if he did or didn't. He thought he did as a president, or he has said over and over and over again, "That information, I believe, belongs to me." So if you have someone who goes on to, "Obviously, this information didn't belong to him. It was classified." Your point is that's not enough. It's what's in the president's thinking. It's his state of mind. It's his intent. Not what the prosecution and some talk show guys think. He had to say, "Now, what about this attorney-client privilege issue? Everybody out there knows what this is. You hire an attorney on a contract case, not even a criminal case. You have to be able to consult that attorney and ask them whatever questions you want. And by asking them whatever questions you want, it doesn't mean you're luring them into some kind of criminal scheme. Explain." -Yeah, so under American law, the attorney-client privilege is one of the most crucial guarantees given to a defendant. The right of a defendant to consult with his attorney, to develop legal strategy with his attorney, to ask his attorney what he is and isn't allowed to do. Jack Smith has taken those sorts of conversations between President Trump and a former lawyer of his named Evan Corcoran, and they've said that the questions President Trump was asking amounted to his enlisting that lawyer in some kind of a criminal conspiracy. Relying on that argument, they've then used conversations between President Trump and his lawyer that would otherwise be privileged, and that underlies a lot of this indictment. Without that information, big chunks, if not all of this indictment, will probably end up being dismissed. So they've run roughshod over attorney-client privilege. They've intruded on conversations that I believe they didn't have a right to intrude on, and that's really at the heart of this case here. Which is why he wants a rush job when it comes to a trial as fast as he can. He doesn't want these issues challenged and so forth. He just wants to have the whole field to himself, and I notice also, just quickly here, Will, they're basically trying to intimidate the federal judge. The federal judge was appointed by Donald Trump, and so you have articles that she's very limited criminal background experience, that she screwed up on the special master appointment issue, that she's in Trump camp and Trump got a favorable appointment. So they're trying to influence the outcome of her decisions on motions and other things so she can get straight with the left, the media, and these anti-Trumpers, no? - Yeah, instead of letting this case play out in court as a normal case would, Jack Smith and his team are playing to the Peanut Gallery. They're playing to the mainstream media. They're trying to make arguments in front of the mainstream media that this judge, who by the way was a former federal prosecutor herself, really an eminent legal mind, they're trying to say that she's somehow biased or somehow not up to taking this case. And the reason for that, Mark, is that they are terrified of litigating some of the very serious legal flaws in the case that they've strung together against President Trump. - Yes or no, 'cause I'm out of time here. These documents are in question that are cited by the prosecution. The defense has a right to see every one of these documents. We have not secret trials, but public trials, and to see every one of these documents in public, in the courtroom, with the press there, and with all the rest of us looking over their shoulders. Yes or no? - Absolutely. The jury has a right to see all of these. For these documents not to be made public would be highly, highly irregular. We're going to get to watch this case unfold in public, and I think that's what the special counsel's scared of. - Well, I wish you all the best. You'd be a fantastic Attorney General of Missouri. I want to thank you, Colonel Kemp, what exactly is going on with Iran and why should America be concerned about it? Well, America should be deeply concerned and the whole world should be just as concerned because what is about to happen, I believe, and obviously we don't know yet when or precisely if, but what looks very likely is that President Biden is about to go into an even worse nuclear deal with Iran than President Obama struck with Iran, and that deal, as you alluded to, was very, very dangerous, essentially rubber-stamping Iran's ability to become a nuclear state. And now Biden is going even further than that. He's making the situation which was bad much, much worse, because under the Obama deal, for example, the Iranians were limited to significantly less than 5% enrichment of nuclear material. Now, since the Obama days, Iran has now enriched up to 60%, 60%, and that 60% is the bottom level that Biden's going to allow, so he's going to allow enrichment to 60%, which is a very short hop, a very, very short hop in terms of technical capability and time to get to the extent required for full weaponization. And what happened before, as I'm sure your viewers will recall, is that President Trump recognized that the Obama deal was terrible, was, you know, paving the way for Iran's nuclear weapons, and he ended it, and he ended it and imposed maximum pressure sanctions on Iran, which kept them suppressed, and it kept the enrichment levels down at 5% or below. Since President Biden has taken office, he's eased up on that right from the very beginning. He's eased up on sanctions. He's allowed illegal oil experts from Iran, contrary to US law, contrary to international law. He's allowed all that to go ahead, and he's allowed Iran to enrich from the level of 5%, which was a maximum under Trump, to 60% now. And now what he's saying is, effectively, you can do pretty much whatever you want. You can carry on building weapons. You can carry on with all other aspects of your nuclear program, including ballistic missiles program. You can effectively carry on with your terrorism around the region. You just can't enrich over 60%, and a reward for that, our reward for that is we're going to unfreeze $20 billion worth of frozen Iranian assets immediately with more to follow, probably hundreds of billions of dollars more to follow, and that's going to enable Iran to work even harder on their nuclear program. It's going to enable Iran to continue supplying vast stocks of drones and in future ballistic missiles to Russia to attack Ukraine, because Iran not only threatens the Middle East and the world with their nuclear program, they also are part and party to Russia's war on Ukraine, being the main weapons supplier to Russia. And all of these things effectively are going to be facilitated by President Biden's deal, which is effectively a capitulation to Iranian blackmail. It's surrendering to Iran. It follows in a series of foreign policy disgraces by the Biden administration, starting with the humiliation of the United States over the withdrawal from Afghanistan, continuing with the invasion of Ukraine by Russia, which I believe happened mainly because of America's weakness over Afghanistan, and even ceding the role of power broker in the Middle East to China. And this is President Biden's foreign policy record. He's now adding to it total capitulation by allowing this deal to go ahead. And the way I read this deal for sure is essentially the U.S., the U.S. administration has given up on trying to contain Iran's nuclear program. They're just accepting Iran will be a nuclear-armed state. And what this is all about is trying to apply pressure on Israel to prevent Israel from dealing with Iran's nuclear program. And that, I think, is the real purpose of this deal, to make it much more complicated for Israel to carry out a serious military strike against the Iranian nuclear program. You shouldn't forget that only Israel has taken an active role in interdicting Iran's nuclear program. And over recent years, Prime Minister Netanyahu, with his close advisor and now Minister Ron Derma, have outmaneuvered U.S. efforts to facilitate the Iranian nuclear deal. And by carrying out covert operations, cyber, sabotage, assassination operations, they've put back the Iranian nuclear program by a number of years. But the hope, I think, by the Biden administration is that those efforts will be curtailed and Israel will be forced to tow the line and allow Iran to become a nuclear-armed state. When we come back, Commander, I don't think Israel's going to sit for this. It's obviously going to make their situation much more complicated when you have a president who appeases the Iranians and sells out the Israelis. On a really two-track kind of diplomatic activity here, which is bending over backwards for the Iranians and trying to prevent the Israelis from defending themselves. And I want to know your opinion about that. I mean, really, is Israel going to allow Iran to have nuclear weapons to threat its population? I mean, they're very close to one another. They don't have an ocean between those two countries.

But it's no wonder this swamp is getting truly desperate as they see us leading very big in the polls. I'm leading very, very big in the polls. In this week's "Just Came Out" big village poll. We lead the field by 41 points. Very nice, 56 to 15 for De Sanctimonious, he's doing good. He's falling like a rock. People are getting to know him. They know he's got no personality. Got to have a little personality, not much, but a little. And we're leading big. In a recent CBS poll, which does not like me, we have 61 percent and the Republicans are down to 11 or 12 or something. And in the new Harvard Harris poll, doesn't love me. We're up by 45 points, leading 45 points, and it's been really amazing. In New Hampshire, we have a 47 percent lead over De Sanctimonious. The reason I call him that is he was dead in the water, couldn't have gotten elected. He came begging for my endorsement. I gave him the endorsement he won. Then they said, "Would you run against the president?" He said, "I have no comment." I said, "That means he's running. This guy." We get him elected. Then he says, "Yes, I'd run." I don't know. They say loyalty doesn't matter in this business. What do you think, Rudy? I think loyalty matters a lot. I think it matters a lot. But we're leading Biden by a lot. In that same Harvard Harris poll, Trump leads Biden 45 to 39. All other Republican candidates are losing to Biden, which is hard to believe, to be honest with you.
